The division of divine will into creation and legislation has been mentioned in the science of theology and the science of principles of jurisprudence since the distant past and it has been mentioned with different interpretations. In the meantime, Sheikh Mohammad Hossein Gharavi Esfahani has deeply thought about the various angles of the legislative will and, while distinguishing it from the "will to legislate" and the "creative will", he negates the legislative will in God and supreme creatures, and with this theory, the view Mohagheq Khorasani corrects and completes. This theory has had a significant impact on later scholars. In this writing, it becomes clear that the Isfahani researcher, on the one hand, does not accept the reference of divine legislative will to divine knowledge, as he also considers it inappropriate to reduce it to legislative will; On the other hand, by presenting two arguments, he denies the existence of legislative will not only in God but also in the supreme creatures, the Prophet (pbuh) and Imams (pbuh). It seems that this theory, despite some outstanding points, has ambiguities and damages, among which we can mention "incompatibility with the culture of hadiths", "utilitarian attitude even towards God" and "reducing religious tasks to exam tasks", which prevent the acceptance of this view. will be However, as mentioned in the text of the article, it is possible to restore and complete his view by using the foundations of Mohagheg Isfahani.
